Freehold and leasehold rights in a Dubai property purchase

The legal interest determines what is owned, for how long and under which conditions. Buyers should establish those rights before comparing price or financing.

The words freehold and leasehold describe different legal interests. They should not be used as shorthand for a good investment and a cheap alternative, or assumed to apply uniformly across an entire Dubai district.

The essential document is the record of the particular right being acquired, read alongside the agreement and applicable rules. A property advertisement is an introduction to that investigation.

Establish the duration and scope

Official UAE guidance states that foreign buyers can acquire freehold ownership in designated Dubai areas, as well as certain usufruct or leasehold rights for up to 99 years. The precise right depends on the property and its legal arrangements.

Freehold is generally an ownership interest without a fixed expiry. A long lease or other time-limited right has a defined duration and conditions. It is different from an ordinary residential tenancy, even though both involve the use of property over time.

For an apartment, establish the unit interest and associated rights in common property. Avoid assuming that ownership of a unit means unrestricted control over the entire building or underlying land.

Read the restrictions and obligations

Freehold ownership remains subject to applicable law, planning, community requirements and the terms relevant to the property. Alterations or a different use may require permissions.

For a time-limited interest, examine the remaining term, transfer provisions, payments and the position at expiry. Renewal should not be assumed merely because a long original term is advertised.

The responsibilities for maintenance, shared services and other costs should be identified under either structure. An obligation that is unclear at purchase can become expensive during ownership or sale.

Compare finance and exit on the actual terms

Ask the proposed lender whether it accepts the property and the interest being acquired. The remaining term and documentation may affect available finance, which in turn can influence the future buyer pool.

A lower price is meaningful only after accounting for duration, obligations and use. Two homes in similar locations may not be directly comparable if the rights are materially different.

Independent legal advice can help resolve unfamiliar or complex arrangements before the buyer becomes committed. The purpose is to establish exactly what transfers and what remains with another party.

A clear ownership structure gives a purchase a sound starting point. It does not guarantee appreciation or rental income. Those investment questions should be assessed after the buyer knows the asset and rights to which the price actually relates.
